WARRANTY POLICY
This Warranty Policy applies to products manufactured and supplied by Louw Roets Design (Pty) Ltd (Registration No. 2017/062319/07), Somerset West, Western Cape, South Africa.

1. Warranty Period
Louw Roets Design (Pty) Ltd warrants that its products are free from material defects in workmanship and manufacturing under normal intended residential use, subject to the terms, conditions and exclusions contained in this Warranty Policy and in addition to any rights the client may have under applicable South African law, including the Consumer Protection Act 68 of 2008, where applicable.
Standard products carry a two (2) year limited workmanship warranty commencing on the date of delivery or collection, whichever occurs first.
Custom-designed, bespoke or commissioned products carry a six (6) month limited workmanship warranty commencing on the date of delivery or collection, whichever occurs first.
The warranty periods above constitute the voluntary manufacturer’s warranty offered by Louw Roets Design (Pty) Ltd and do not limit, exclude or replace any statutory rights that cannot lawfully be excluded under applicable South African legislation.

2. Warranty Remedy
Should a manufacturing defect arise during the applicable warranty period, Louw Roets Design (Pty) Ltd reserves the sole and absolute discretion to inspect, repair, refinish, replace the affected component or replace the entire product where considered appropriate.
The remedies contained in this Warranty Policy constitute the client’s sole contractual remedy under this voluntary warranty and are subject to applicable South African law.

3. Warranty Exclusions
This warranty excludes damage, defects or deterioration arising from or relating to:
Normal wear and tear.
Natural ageing of timber, leather, stone, engineered stone, metals, finishes and patinas.
Natural expansion, contraction, movement, checking, splitting, shrinkage or minor cracking of timber.
Natural colour, grain, figure, texture, veining, knots, sapwood, mineral streaks, insect markings or other inherent characteristics of natural materials.
Natural variations between showroom samples, photographs, previous orders and finished products.
Changes in colour resulting from UV exposure, oxidation or ageing.
Improper use, abuse, neglect, accidents or impact damage.
Commercial, hospitality or institutional use where the product was intended for residential use.
Outdoor use, including use on patios, verandas, balconies, pergolas, covered outdoor areas or any environment exposed to natural weather conditions, humidity, moisture, UV radiation or fluctuating temperatures, unless the product has been specifically designed, manufactured and sold for outdoor use.
Exposure to excessive sunlight, moisture, humidity, coastal environments, excessive dryness, rapid temperature fluctuations or other adverse environmental conditions.
Incorrect handling, storage or installation.
Failure to follow the recommended care and maintenance instructions.
Transport, shipping or handling by any third-party courier, freight forwarder or transport company.
Repairs, alterations or modifications carried out by anyone other than Louw Roets Design (Pty) Ltd without prior written approval.
The installation or use of third-party hardware, fittings or accessories.
Damage caused by improper installation by third parties.
Acts of God, floods, fire, storms, earthquakes, civil unrest, war, pandemics, supplier delays, load shedding or any force majeure event beyond the reasonable control of Louw Roets Design (Pty) Ltd.

4. Client-Supplied Materials
Louw Roets Design (Pty) Ltd accepts no responsibility or liability whatsoever for the quality, suitability, structural integrity, durability, compatibility or performance of any materials, components or products supplied by the client or any third party acting on the client’s behalf.
No warranty whatsoever is provided in respect of client-supplied materials, including but not limited to timber, veneer, leather, fabric, engineered stone, natural stone, marble, granite, metal, brass, bronze, glass, hardware, upholstery or any other material incorporated into the finished product.
Where any defect, movement, incompatibility, staining, structural failure, dimensional instability, colour variation or manufacturing limitation arises from client-supplied materials, Louw Roets Design (Pty) Ltd shall bear no responsibility or liability whatsoever. Any additional labour, replacement materials or remedial work required shall be charged separately.

5. Natural Materials
Wood, leather, natural stone, engineered stone, metals and other natural materials are inherently unique and will naturally vary in colour, grain, figure, texture, veining, density and appearance.
Variations in colour, grain, figure, texture, movement, patina, pores, mineral deposits, knots, surface checking and other natural characteristics form part of the character of each handcrafted piece and shall not constitute defects.
Exact colour, grain, texture or pattern matching between showroom samples, previous orders, photographs or natural materials cannot be guaranteed.
Patinated metals and metal finishes will naturally change over time due to oxidation, handling and environmental exposure. These changes form part of the intended ageing process and are not covered by this warranty.
Timber furniture intended for indoor use must be maintained in a stable indoor environment. Placement on patios, verandas, balconies, under pergolas or in other semi-outdoor or covered outdoor areas may expose the product to elevated humidity, moisture, condensation, direct or indirect sunlight and temperature fluctuations, which may result in movement, warping, cracking, discolouration or deterioration. Such environmental exposure is specifically excluded from this warranty unless the product has been designed and sold for outdoor use.

6. Care & Maintenance
The client is responsible for maintaining the product strictly in accordance with the care and maintenance instructions supplied by Louw Roets Design (Pty) Ltd.
Failure to follow the recommended care and maintenance procedures may invalidate this warranty.

7. Installation
This warranty applies only where installation has been carried out by Louw Roets Design (Pty) Ltd or where installation by others has been expressly approved in writing.
Louw Roets Design (Pty) Ltd accepts no responsibility for damage arising from incorrect installation, assembly or handling by third parties.

8. Transferability
This warranty applies solely to the original purchaser and is not transferable without the prior written consent of Louw Roets Design (Pty) Ltd.

9. Warranty Claims
Warranty claims must be submitted within seven (7) calendar days after the alleged defect first becomes apparent.
Claims must be submitted by email to admin@louwroets.co.za with the words “Warranty Claim” together with the relevant order number in the subject line.
The client must provide:
Original order or invoice number.
Detailed description of the alleged defect.
Clear high-resolution photographs.
Any additional information reasonably requested by Louw Roets Design (Pty) Ltd.
No warranty claim will be considered until sufficient photographic evidence and supporting information have been received.
Failure to report a defect within the prescribed period after discovery may prejudice or invalidate the warranty claim.

10. Inspection
Louw Roets Design (Pty) Ltd reserves the right to inspect any product before accepting or rejecting a warranty claim.
Where necessary, the client may be required to return the product or the affected component to our premises for inspection.
Unless otherwise agreed in writing, all transport, packaging and insurance costs associated with warranty inspections shall be for the client’s account.

11. Limitation of Liability
Except where prohibited by South African law, this warranty is limited solely to the repair, refinishing or replacement of defective workmanship or materials at the sole discretion of Louw Roets Design (Pty) Ltd.
To the fullest extent permitted by law, Louw Roets Design (Pty) Ltd shall not be liable for any indirect, incidental, consequential, special or economic loss whatsoever, including but not limited to:
Loss of profits.
Loss of income.
Business interruption.
Project delays.
Accommodation costs.
Transport costs.
Removal or reinstallation costs.
Third-party contractor costs.
Any consequential or indirect damages.

12. Governing Law
This Warranty Policy shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Nothing contained herein shall exclude or limit any statutory rights which cannot lawfully be excluded under South African legislation.

13. Entire Warranty
This Warranty Policy should be read together with the Terms & Conditions of Sale of Louw Roets Design (Pty) Ltd.
In the event of any inconsistency, the Terms & Conditions of Sale shall prevail except where this Warranty Policy expressly provides otherwise.
No employee, agent or representative of Louw Roets Design (Pty) Ltd has authority to amend this Warranty Policy unless such amendment is recorded in writing and signed by a duly authorised representative of the company.
